PAINTING COMMISSION TERMS


PROPOSAL

Megan only has space for a few commissioned paintings each year, so not all proposals will be accepted. Please be aware that Megan will only take on painting commissions that align with her current art style.

Accepted proposals will receive confirmation of acceptance within 7 days with an invoice for the deposit. Unsuccessful proposals will be notified within 7 days as well.

SUBJECT MATTER

To increase your chances of your proposal being accepted, know that Megan’s preferred subject matter includes: people, animals, plants, and nature. She is open to other concepts, so feel free to bring forward your ideas if they are not included in the list above.

Subject matter that will be declined includes (but is not limited to): human family portraits (pet portraits welcome!), copyrighted characters, copies of another artist’s work, and art styles other than Megan’s own.

PAYMENT

Once your proposal has been accepted, you will receive an invoice for a non-refundable 50% deposit. No work on the painting or the concept design will commence before the deposit is received. The deposit goes towards the cost of art materials for your painting and for some of the time that goes into the consultation, concept design, and painting process.

Once the painting is complete, you will receive an invoice for the remaining 50%. Payment  is expected to be prompt, and can be made via Australian bank transfer or international wire transfer. The painting will be shipped once the final payment has cleared. If the final payment has not been received within 30 days from the date of invoice, the painting will be re-sold with no refund to you. Exceptions may be made under extreme circumstances, and that decision is up to the discretion of the artist.

CONSULTATION

A Zoom consultation appointment will be booked for you once the initial 50% deposit has been received. This is where you and the artist will discuss your aspirations for the artwork. We will touch on the meaning and subject matter behind the piece, as well as your aesthetic preferences.

TIMELINE

Your painting commission will take between 4 to 8 weeks to complete, before it will be ready for shipping. This varies based on the scale and complexity of the artwork.

ADJUSTMENTS

Following the Zoom consultation, you will be provided a digital concept design for your painting. Up to 2 adjustments to the concept design are included in the commission price. These adjustments apply to the digital concept design only and not the physical painting. Adjustments will be up to the discretion of the artist, and requests that will compromise the aesthetic quality of the artwork will not be accepted. If further adjustments are requested, a fee of $150 per adjustment will be added to the final price.

Once the concept design has been approved, Megan will drawn upon it for inspiration for the physical painting. Please understand that the final painting will not look identical to the digital concept design, as the medium of paint will have its own unique texture and brushstrokes.

ETIQUETTE

The following terms and conditions exist to encourage a respectful and mutually beneficial experience for the client and artist:

As Megan works within strict deadlines, timely responses to emails are encouraged. Delayed responses can lead to delayed production of your artwork.

Harassment, bullying, and discrimination will not be tolerated under any circumstances and the artist reserves the right to terminate the commission without refund in extreme circumstances.

If an adjustment request had been denied, please respect the artist’s decision and trust in her artistic expertise.

The deadlines offered are non-negotiable, as Megan has many other clients that require her time and attention. Tight deadlines will be denied.

Frequent emails and other forms of communication indented to speed up production time are not welcomed and will only delay the completion of the artwork. Good creative work suffers under stress and undue pressure.

PRICING

Once your commission has been accepted, the price will locked into the agreed upon amount unless further adjustments are required.

The artist retains the right to increase the price of any and all future paintings and commissions. This is industry standard and will increase the value of your original artwork over time.

Commissioned artworks take a considerable amount of extra time for consultation and preparation, meaning the prices will be higher than similarly sized paintings available in the online gallery.

SHIPPING

Megan offers free insured international shipping via professional courier for all commissioned artworks. This insurance only covers the delivery of the artwork, and does not extend past that point. It is advised you insure your artwork independently once it has arrived.

RETURNS + LIABILITY

All commissioned artwork purchases are final. This is non-negotiable, as your artwork is customised just for you and comes with a certificate of authenticity. Megan also pays a considerable amount for packaging and insured shipping via courier to ensure your painting arrives to you safe and sound.

As the 50% deposit goes towards the cost of art materials for your painting and for some of the time that goes into the consultation, concept design, and painting process - it is strictly non-refundable.

INTELLECTUAL PROPERTY

When you commission an artwork, you own the original artwork and reserve the right to display the physical artwork in your home, office, or business. The artist retains the intellectual property rights and reproduction rights to any and all artwork produced. This includes and is not limited to the means of resale through prints and merchandise. The purchase of intellectual property rights to the artwork is firmly unattainable and is non-negotiable.
